Recent cases before Judge James Martin

The following recently had cases before District Judge James Martin of Johnsonburg:

-Philip Bradley Wolfel, 30, of Wilcox, was held for court on a felony charge of strangulation-applying pressure to throat or neck, a misdemeanor charge of simple assault and a summary offenses of harassment-subjecting others to physical contact. Bail was set at $25,000 monetary, straight cash. Bradley was remanded to the Elk County Prison as he was unable to post bail.

-Brooke Morgan Dececchis, 23, of Ridgway, was waived for court on misdemeanor charges of intent to possess a controlled substance by a person not regulated, marijuana-small amount for personal use and three counts of use/possession of drug paraphernalia. Bail was set at $5,000 monetary, straight cash. Dececchis was remanded to the Elk County Prison as she was unable to post bail.

-Brian James Braun, 26, of Johnsonburg, was waived for court on misdemeanor charges of DUI with a blood alcohol level of .08-.10, DUI with a high rate of BAC .10-.16 and DUI with the highest rate of BAC .16+ and summary offenses of accident damage to unattended vehicle or property, and careless driving. Bail was set at $2,500 non-monetary, unsecured.

-David James Kennedy, 37, of Ridgway, was waived for court on a misdemeanor charge of DUI controlled substance-impaired ability first offense and summary offenses of failure to carry registration, operating a vehicle without required financial responsibility, disregard for a traffic lane and careless driving. Bail was set at $5,000 non-monetary, unsecured.

-Travis Michael Cameroni, 27, of Ridgway, was waived for court on misdemeanor charges of DUI general impairment-first offense, DUI with a blood alcohol level of .08-.10, DUI with a high rate of BAC .10-.16 and DUI with the highest rate of BAC .16+ and summary offenses of disregard for a traffic lane, careless driving, and failure to use a safety belt system-driver and front seat occupant. Bail was set at $2,500 non-monetary, unsecured.

-Samuel James Delhunty, 22, of Ridgway, was waived for court on misdemeanor charges of DUI general impairment-first offense, DUI with a blood alcohol level of .08-.10, DUI with a high rate of BAC .10-.16 and DUI with the highest rate of BAC .16+ and summary offenses of disregard for a traffic lane and careless driving. Bail was set at $2,500 non-monetary, unsecured.

-John Curtis Hutchins, Sr., 53, of Deyoung, had a misdemeanor charge of simple assault withdrawn and a summary offense of harassment-subject others to physical contact was moved to a non-traffic violation. Bail was set at $5,000 non-monetary, unsecured.
Hutchins entered into a guilty plea agreement in which the state withdrew the simple assault charge and entered a guilt plea to the summary charge. As part of his sentence Hutchins must pay a $25 fine, a cost of $160.25, for a total of $185.25.

-Bradley Allan Harvey, 27, of Ridgway, was waived for court on a misdemeanor charge of DUI general impairment-first offense and summary offenses of failure to keep right, disregard for a traffic lane, and careless driving. Misdemeanor charges of DUI with a blood alcohol level of .08-.10, DUI with a high rate of BAC .10-.16 and DUI with the highest rate of BAC .16+ were withdrawn. Bail was set at $2,500 non-monetary, unsecured.

-Nicklas Terry Desmond, 40, of Ridgway, was waived for court on a misdemeanor charge of DUI general impairment-first offense and summary offenses of driving while operating privileges suspended or revoked, turning movements and required signals, careless driving, and failure to use a safety belt system-driver and front seat occupant. Misdemeanor charges of DUI with a blood alcohol level of .08-.10, DUI with a high rate of BAC .10-.16 and DUI with the highest rate of BAC .16+ were withdrawn. Bail was set at $2,500 non-monetary, unsecured.

-George James Frederick, 29, of Ridgway, was waived for court on a misdemeanor charge of use/possession of drug paraphernalia and a summary offense of duties at a stop sign. A misdemeanor charge of marijuana-small amount for personal use was withdrawn. Bail was set at $2,500 non-monetary, unsecured.

-Thomas Aaron Titchner, 43, of Ridgway, was waived for court on a misdemeanor charge of DUI general impairment-first offense and summary offenses of turning movements and required signals and careless driving. Misdemeanor charges of DUI with a blood alcohol level of .08-.10, DUI with a high rate of BAC .10-.16 and DUI with the highest rate of BAC .16+ were withdrawn. Bail was set at $2,500 non-monetary, unsecured.

-Thomas Michael McDivitt, 47, of Pittsburgh, was held for court on misdemeanor charges of DUI general impairment-first offense, DUI with a blood alcohol level of .08-.10, DUI with a high rate of BAC .10-.16 and DUI with the highest rate of BAC .16+ were withdrawn. Bail was set at $2,500 non-monetary, unsecured and summary offenses of failure to keep right, disregard for a traffic lane, and careless driving. Bail was set at $2,500 non-monetary, unsecured.

-Leslie Marie Litzinger, 49, of Madera, was waived for court on misdemeanor charges of two counts of theft by unlawful taking-movable property and two counts of receiving stolen property. Bail was set at $5,000 monetary, straight cash then changed to $5,000 non-monetary, unsecured. Litzinger was remanded to the Elk County Prison as she was unable to post bail.

-Kyle Augstin Reed, 27, of Ridgway, was waived for court on misdemeanor charges of DUI general impairment-first offense, DUI with a blood alcohol level of .08-.10, DUI with a high rate of BAC .10-.16 and DUI with the highest rate of BAC .16+ and summary offenses of disregard for a traffic lane, careless driving, and no rear lights. Bail was set at $2,500 non-monetary, unsecured.

-Robert William Cheatle, 31, of Johnsonburg, was waived for court on a misdemeanor charge of theft of services-acquisition of services. Bail was set at $5,000 non-monetary, unsecured.

-Shaun Ryan Tavakolnia, 35, of Spencer, Massachusetts, was waived for court on a misdemeanor charge of simple assault and a summary offense of harassment-subjecting others to physical contact. Bail was set at $15,000 monetary, straight cash then changed to $15,000 non-monetary, unsecured. Tavakolnia was remanded to the Elk County Prison as he was unable to post bail.

-Robert Thomas Maher, 55, of Sheffield, was held for court on misdemeanor charges of marijuana-small amount for personal use, use/possession of drug paraphernalia, and DUI controlled substance-impaired ability, and summary offenses of exceeding maximum speed limit established by 15 mph and reckless driving. Bail was set at $2,500 non-monetary, unsecured.

-Olivia Marie Oknefski, 26, of Ridgway, was waived for court on misdemeanor charges of endangering the welfare of a child-parent/guardian committing offense, recklessly endangering another person, intent to possess a controlled substance by a person not regulated and use/possession of drug paraphernalia. Bail was set at $5,000 monetary, straight cash. Oknefski was remanded to the Elk County Prison as he was unable to post bail.

-Brittany Lynn Peters, 27, of Oil City, had a misdemeanor charge of defiant trespassing/actual communication withdrawn and a summary offense of disorderly conduct-hazard/physical offense moved to a non-traffic violation. Bail was set at $2,500 non-monetary, unsecured.
Peters entered into a plea agreement whereby the state withdrew the trespassing charge. Peters entered a guilty plea to the summary offense. As part of her sentencing Peters must bay a fine of $1 and a cost of $160.25.

-Acacia Shade Chaplain, 23, of Ridgway, had a misdemeanor charge of simple assault withdrawn, a summary offense of harassment-subjecting others to physical contact changed, and a summary offense of disorderly conduct moved to a non-traffic violation. Bail was set at $5,000 non-monetary, unsecured.

-Daniel Edward Geer, 34, of Ridgway, was waived for court on misdemeanor charges of three counts of use/possession of drug paraphernalia. Bail was set at $5,000 non-monetary, unsecured.

-Samantha Jo Wall, 23, of Ridgway, was waived for court on misdemeanor charges of two counts of use/possession of drug paraphernalia, marijuana-small amount for personal use, and summary offenses of disorderly conduct, and public drunkenness and similar misconduct. Bail was set at $5,000 monetary, straight cash then changed to $5,000 non-monetary, unsecured. Wall was remanded to the Elk County Prison as she was unable to post bail.

-Travis Joseph Weisner, 18, of St. Marys, was waived for court on a misdemeanor charge of DUI general impairment-first offense and summary offenses of purchasing alcoholic beverages by a minor, operating a vehicle without required financial responsibility, failure to keep right, disregard for a traffic lane, duty of a driver in emergency response areas-passing in a lane not adjacent to the area, and careless driving. A misdemeanor charge of DUI minor-first offense was withdrawn. Bail was set at $2,500 non-monetary, unsecured.

-Michael Charles Matthews, 32, of Saxton, had a misdemeanor charge of use/possession of drug paraphernalia withdrawn along with a summary offense of retail theft-taking merchandise. Bail was set at $5,000 monetary, straight cash. Matthews was remanded to the Elk County Prison as he was unable to post bail.
